ICE Implements New Strategy

Immigration and Customs Enforcement has charged a California restaurateur with 12 felonies for knowingly hiring undocumented workers. Please see LA Times story for details. ICE moves for jail time and forfeiture of restaurant.

Strategies will continue to evolve until the United States implements some version of immigration reform. The case certainly reminds every restaurant to regularly review their hiring procedures:

  • All i9s are current form and filled out correctly and completely for every employee.
  • Accessible binder for all current employee i9s (otherwise have to show employee files to ICE agents which may not be in your interest).
  • Inform all managers of procedures if ICE walks in.
  • If received, review non-matching notification from Social security Administration in detail.
  • Consider meeting with each employee listed in notification to review proper documentation.
  • Consider E Verify program (not currently required by law).
